Most Tenants receive free legal counsel or, at a minimum, advice from a free attorney; it is more important than ever that Landlords have their own experienced attorney who can properly commence, maintain, and argue the case on their behalf.

The two main type of evictions are Nonpayment cases and Holdover cases.

NONPAYMENT CASES:

These types of cases involve the tenant’s failure to pay rent, and due to recent case law precedent, a nonpayment proceeding requires an active lease.
If your tenant is not paying the rent and you still have an active lease, then we should commence a nonpayment case immediately. The first step will be a 14-day rent demand and a 5-day notice of late rent.

HOLDOVER CASES:

There are numerous types of holdover proceedings, including but not limited to:

  • Failure to pay rent but no active lease holdover;
  • Non-renewal of lease;
  • Termination of month-to-month tenancy;
  • The tenant of record vacated, but other occupants;
  • You gave someone permission to stay for free but now will not leave;
  • Breach of lease holdover;
  • Nuisance holdover;
  • Illegal sublet holdover;
  • Failure to renew lease holdover;
  • Non-primary residence holdover and a few others
